July 16, 2026 Message from Receiver
The Honorable Bruce H. Hendricks, United States District Court Judge for the District of South Carolina, has granted the Motion of the Receiver filed on June 12, 2026 and issued an Order approving the Amended Schedule of Net Loss Amounts and Initial Distribution Amounts. The Receiver has now authorized the checks to be issued to Court approved claimants. This distribution will be made in accordance with the Plan for Claims Administration and Distribution of Proceeds approved by the Court on February 4, 2026.
The Amended Schedule attached includes 1021 Court-approved Claimants. By distributing $7 million and applying the "Rising Tide" method of distribution, the initial amount to be distributed to a Claimant from the Receiver PLUS any amount previously received from Scott A. Kohn/Future Income Payments, LLC and/or third party settlements will equal at least 28.45% of their FIP investment. This means, however, that if a Claimant previously received 28.45% or more of their FIP investment, they will not receive an initial distribution from the Receiver.
A much smaller distribution will likely be made at a future date.
